No HOA doesn't mean no rules at your dock

A lot of buyers hear no HOA and assume that means nobody controls what they can build at the water. It is one of the more common misunderstandings I run into, and it is worth clearing up before it costs someone a permit fight.

What it does not tell you

No HOA means there is no community association charging dues and enforcing a private set of architectural rules. It says nothing about the city, the county, or the Army Corps of Engineers, all of which still have jurisdiction over anything you build at the water regardless of whether a homeowners association exists.

Three waterfront lots without an HOA can still have three different sets of rules governing the dock:

  • City zoning code setting a maximum dock or lift projection into the waterway, which applies whether or not there is an HOA.
  • A deed restriction from the original developer, still in force decades later, that has nothing to do with a homeowners association.
  • Army Corps of Engineers jurisdiction, which applies to work in navigable waterways independent of any local authority.

The three questions that settle it

What does the city’s waterfront zoning code actually allow for dock and lift projection on this specific lot? This is public record and worth pulling before you assume anything.

Is there a recorded deed restriction on this property, separate from any HOA, governing what can be built at the water? A title search should surface this, but it is worth asking directly.

Does the planned dock or lift work require Army Corps sign off in addition to city permitting? Depending on scope, it might, and skipping that step is how projects get stopped mid construction.

Why I lead with this

I have watched buyers assume no HOA means no oversight, then find out during permitting that the city’s setback rule is stricter than what they planned to build. It rarely kills a deal, but it is a conversation better had before you are attached to a specific dock layout than after.

If you are looking at a property and want to know what you would actually be allowed to build at the dock, send me the address and I will help you find out.

Thinking about buying or selling on the water?

Tell me what you want to be able to do from your dock and I will tell you honestly which canals work and which ones do not.
